Purpose:

Removal of Restricted Covenant for Doctor’s Surgery to enable change of use subject to planning permission.  This piece of land was disposed by Tunbridge Wells Borough Council in 1986 for use as a doctor’s surgery.  Following the development of the ‘Southborough Hub’ this building is now longer used as a medical centre and to be brough into beneficial use the freehold owners have requested the removal of this restrictive covenant so the use of the property is no longer limited to a medical use. 

Decision:

RESOLVED – That the recommendations set out in the exempt report be agreed. 

Reasons for the decision:

The removal of the Covenant would remove the restrictions currently in place and allow the land to be used for alternative purposes. 

Alternative options considered:

Do nothing – If the covenant were not removed, the building may be left vacant and unutilised for a significant amount of time.
