Revised Statement of Licencing Principles for Gambling Act 2005 Policy 2022-2025 pdf icon PDF 148 KB

Discussion and questions from Members included the following:

 

-       It was confirmed the front page of Appendix A was showing the old dates.  This would be amended to show the correct dates (2022-2025).

 

RESOLVED –

1.    That a 6-week consultation would be undertaken on the proposed revised Tunbridge Wells Borough Council’s Statement of Licencing Principles for Gambling Act 2005 Policy, drafted in accordance with the Gambling Commissions Guidance issued to Licencing Authorities as amended.

2.    That a further report would be submitted after the conclusion of the consultation including consideration of any comments prior to formally recommending a revised Statement of Principles for the Gambling Act 2005 to Full Council for adoption.

Sharon Bamborough, Head of the Licencing Partnership introduced the report set out in the agenda.

 

Discussion and questions from Members included the following:

 

-       In terms of funding, for Taxi and Private Hire licences the Council were allowed to adjust the costs with the aim of providing a cost neutral service.       

-       For other types of licences, Central Government issued statutory fees that had been unchanged since 2005. 

-       Expenditure for licencing functions was £242k per year.  There was a net shortfall of £33k, to be paid by the tax payer.

-       The Licencing Partnership were not currently actively looking for other authorities to join the Partnership.  But there was an option for review at a later date.

-       Compliance and enforcement work had been interrupted due to the Pandemic.  This had the effect of reducing the number of enquiries and complaints.

-       Once the initial effects of the Pandemic had diminished, compliance and enforcement work resumed.

 

RESOLVED – That the performance of the Licencing Partnership as contained within the report be noted and the Head of the Licencing Partnership be asked to continue to provide an annual update of the Licencing Partnership activity to the Licencing Committee each municipal year.

-       Sharon Degiorgio, Senior Licencing Officer provided an update to advise Members that the Council was in the process of placing a contract with a number of garages to undertake vehicle testing.  All Taxi’s and Private Licence Vehicles licenced by the Authority were subject to an M.O.T and Compliance Test twice yearly.  The Council had previously paid the garages directly and then recovered the cost via the Vehicle Taxi Licence Fees.

-       To reduce the administrative burden on the Council, the new contract would place the onus on the proprietor or the driver to pay the garage directly.  Licence fees would be reduced to reflect the change and the contract would be at nil cost to the Council. 

-       The Council was obligated to ensure garages met the required standard and able to undertake the additional defined compliance along with the standard M.O.T test.  All completed test returns would be submitted electronically that would ensure the Authority had evidence that the vehicle had been tested and had passed to the required standard. 

-       It was proposed that the new contract would come into effect in October 2021 for a period of 3 years. 

-       The Council had received a number of expressions of interest which were currently being assessed.

-       All garages were required to be within the Borough of Tunbridge Wells.
