The Chairman opened the meeting, introduced Committee members and officers in attendance, and outlined procedural matters of the meeting.

RESOLVED – That, pursuant to section 100A (4) of the Local Government Act 1972 and the Local Government (Access to Information) (Variation) Order 2006, the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Part I of Schedule 12A of the Act, by virtue of the paragraphs shown below:


Paragraph (1) – Information relating to any individual.

Paragraph (2) – Information which is likely to reveal the identity of an individual.

Paragraph (7) – Information relating to any action taken, or to be taken, in connection with the prevention, investigation or prosecution of crime.

This hearing had been arranged following an application from Kent Police on 20 September 2019 for a summary review of the premises licence for Envoy Nightclub. Since that time an Interim Steps Meeting was held on 23 September 2019.  The application and the record of consideration of the Interim Steps Meeting were provided for consideration within the public agenda.


At the hearing on 11 October, the Chairman ascertained that both parties: PS Beresford on behalf of Kent Police and Mr Dadds (solicitor for the Licence Holder) had discussed and agreed proposed conditions relating to the Licence and these were presented to the Sub-Committee for their consideration.  Both parties were also able to summarise any relevant points.  Members of the Sub-Committee had the opportunity to ask questions and obtained further clarification in respect of the proposed conditions. 


Members of the Sub-Committee then retired to discuss the proposed conditions accompanied by the Council’s legal representative and the Democratic Services Officer.


Decision: The hearing was reconvened and the Chairman relayed the Sub-Committee’s decision in respect of the proposed conditions.  It was confirmed that a written decision notice would follow within the next few working days. 


RESOLVED – That the conditions of the premises licence and those relating to the interim steps be modified as set out in the decision notice appended to these minutes.
